Overview

The Adoption Bill, 2024 will strengthen the legal framework for adoptions, ensuring rights are upheld and that they the necessary safeguards in place to support persons involved in the adoption process.

Legislation Highlights:

  • Modernisation and Replacement: The Adoption Bill aims to replace outdated legislation, including the Adoption of Children Act (2021 Revision) and the Adoption of Children Act (2013 Revision), providing a modern framework for adoption processes in the Cayman Islands.
  • Consideration for Different Types of Adoptions:  the Adoption Bill outlines various different processes and eligibility criteria for different types adoptions all which aim to streamline the adoption process within the Cayman Islands further.
  • Comprehensive Adoption Framework: It outlines detailed roles for the Adoption Board, Department, and Court in adoption proceedings, including processes for intercountry adoptions, adoption orders, and the management of adoption records.
  • International Standards and Safeguarding: The legislation aligns with international adoption standards, contributing to intended ratification of the 1993 Hague Intercountry Adoption Convention. This effort prioritises child safety and addresses concerns related to child trafficking and illegitimate adoptions.
  • Positive Social Impact: The new framework is expected to enhance family integration and support the inclusion of relatives, foster parents, and intercountry adoptions, contributing positively to the social fabric of the Cayman Islands.
  • Comprehensive Consultation Process: Extensive consultations in 2023 and 2024 with stakeholders, such as focus groups and government organisations, have informed the Bill's development, ensuring it meets the community needs and international standards.
